Legal Question in Traffic Law in New Jersey

Suspension in one state, risks in another

I recently got into a ''paint swap'' with another vehicle. I was uninsured (as my husband and I couldn't afford coverage) and I got a ticket for no insurance. I was also told that I would have to appear in court to get my license suspended. I was planning on moving to NY only TWO weeks later to put the car out of commision and work a job that requires a valid lisence. And I was going to use a vehicle that had insurance. My questions are these, if I switch my license in NY, before the suspension, will the NJ suspension affect me there; and in what ways? Also, after I get to NY, what is the best way to resolve the ticket and fees in NJ?

As a side note, I want to add that moving to NY is a must since I am also 5 mos pregnant and need reliable (ie family) transportation to apts and delivery. Plus, the job I would be working (a profitable paper route job) is the only thing I know I can do with a 1 year old and second baby. Thanks ahead of time.

Re: Suspension in one state, risks in another

Driving with no insurance carries a mandatory one year loss of license in New Jersey. You have to appear in court because the court will actually physically take your driver's license away from you in court to ensure that you will not drive and pretend your license is still good. Regarding moving to New York and getting a license there, the concept of "comity" says that any sentence imposed in one state will be honored in every other state. In your case this means that if your license from New Jersey is suspended, then you will not be able to get a license in New York for the period of suspension either. I feel bad for you in this situation, but New Jersey has very strict laws for driving without insurance. I am an attorney who has handled many cases similar to yours in the courts in New Jersey in the past. If you have any questions about this case or any other legal or traffic questions in the future please call me at 1-908-272-0111. Thank you.
