Legal Question in Traffic Law in New Jersey

suspensions

A guy who works with me has a New York Licence but was stopped in New Jersey and had no Insurance. The state of NJ gave him a surcharge and he claims to have paid it up to date ( he is on a payment program) his license privilages in New jersey are coming up SUSPENDED after he wa sinvolved in a minor MVA and now his job in NJ as a driver are in jeapordy. He has a NY licence, but suspended in NJ. How does this happen and what can he do about this?

Although there is some information missing from your question, I assume that your friend never fought the original ticket for driving with no insurance, because if his car is principally garaged and registered in NY, the matter could have been dismissed. The only way to see why his license is suspended is to contact DMV and to examine his records. If you require assistance, please contact this office.

If your friend was convicted in New Jersey of Driving with no insurance on the vehicle this leads to an automatic one year suspension of your driving priveleges. Even though he has a New York license, each state gives full faith and credit ot the laws of every other state, so that is why his New York license was suspended. In New Jersey even if you are on a payment paln for surcharges you still have to wiat until your year long suspension is up before you can apply to have your driving priveleges restored - they are not automatically restored. My advice would be to contact the New York Division of Motor Vehciles to find out what he needs to do, and when he is allowed to do it, to get his driving priveleges restored.
