Legal Question in Traffic Law in New Jersey

Wrong license number on ticket

If the traffic violation (No Turns) was given and the wrong license number was written on the ticket. Does that give me any lee way in trying to get the ticket dismissed?

If you actually did not commit the violation and it wasn't you who was given the ticket, then maybe. If it is just a writing error by the officer issuing the ticket, then no. I am an attorney who has handled many cases similar to yours in the past in various courts in New Jersey. I would like to discuss your case with you further. Please call me at 908-272-0111 to discuss how I can help you in this matter. There is never any charge for simply discussing a case with me. Thank you.

Re: Wrong license number on ticket

The court rules require that a traffic summons issue within thirty days or whatever is required for the particular offense charged and the summons adequately give notice of the offense charged so that the defendant be reasonably able to meet the charge in court. A clerical error such as erroneously recording the license plate of the car involved is of no real consequence if the summons was issued and given to you and you know what you are supposed to have done wrong.

The answer to this type of question usually depends on the judge. You can certainly argue that the ticket is fundamentally defective, and ask for a dismissal. Some municipal court judges will dismiss, some will allow the case to go forward.
