What happens if there was a dying family member, that signed a new will, under morphine, (In the hospital) that totally went against all she said while she was alive? What happens when 50\50 between 2 brothers goes to 75\25, and that brother is a lawyer? Can the "new will" that negates all other wills" be just and legal?and is there a statue of limitations on contesting a will in the state of N.J.???
A will requires that the testator have will, mental capacity. Mental incapacity would invalidate the new will. Of course, there is the inevitable will contest.
