Legal Question in Wills and Trusts in New Jersey

Hand Written Will

My sister recently passed away.

She had filled out a form will in which she hand wrote her intentions. This will was notarized.

Is this a legal will?

Her husband had filed for divorce but she had pass away from cancer before it was valid. He is trying to receive money that was still open with a lawyer from an accident.

Please advise

I will need to examine the document to determine whether or not it is a valid Will. It's possible it may be valid as a holographic (handwritten) Will. Also, your sister's husband may have a claim, depending on the status of the divorce action. I would need to review all the papers that have been filed in that case in order to determine if he has no claim.

An attorney would need to view the document to determine if it is likely a legal will.

It depends on the state of the divorce action at the time of death as to whether the husband had a valid claim.
