Legal Question in Wills and Trusts in New Jersey

Will drafted in state of NJ. Want to know the correct way to state "issue per stripes" Please advise if its used correctly in the following statement. In the event that my wife has failed to survive me, then I give, devise and bequeath all the rest residue and remainder of my Estate, which I now have or may hereinafter acquire and which I own at my death to my sons, ABC and DEF, or their issue per stripes. Should "or their" be taken out?

Thank you

DIY wills are not a good idea. They are fill-in-the-blanks, do not cover issues that each person should think about, and may not be valid or lead to costly contests after you die.

Your will documents should also include Power of Attorney, Health Care Directives and Health Care Power of Attorney.

Have an estates lawyer help you. The cost will be relatively small compared to what it will cost your heirs to straighten out the resulting mess -- unless you don't care about the problems they will have at that time. Do you really want to risk your documents being ineffective?

THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
