Legal Question in Wills and Trusts in New Jersey

In my will I stated I want my brother to get everything I have when I die. I don't want my daughter to receive anything because she is in a state facility and it would only go to the state. As legal guardian of my daughter (who is in the state facility)could the state take any part of my estate because of my being her quardian?

Only if you are holding funds that will go to her when you die. Have you considered a "Special Needs Trust" for her that will not disqualify her for continued assistance?
