Legal Question in Workers Comp in New Jersey

back injury

I have had previous problems with my back including a slightly herniated disk about 8 years ago. I recently hurt my back at work due to moving heavy items around in tight spaces and twisted my back and now have pain in my lower back and cannot work. I may have a herniated disk again. Am I still entitled to be covered by worker's comp because I did hurt myself at work.

Yes, you are entitled to workers compensation benefits for this new back injury even though you had the other back problem 8 years ago. In fact it sounds to me like you have a very good case. If you have not reported your back injury to your employer, you must do so immediately. You are entitiled to free medical coverage for your work related injuries, but you must report the accident and injury to your employer to get this. If the workers compensation doctor puts you out of work for at least 8 days, you are also entitled to receive temporary disability benefits in the amount of 70% of your base pay until he clears you to go back to work. Finally, for the type of injury you have there is a good chance that we can get you a permanent disability award, meaning money for getting hurt on the job.
