Legal Question in Workers Comp in New Jersey

Injury to Minor Child

My son is 17 and worked in a nursing home laundry dept. He was injured (torn rotater cuff). The employer won't report the injury, due to my son's age'and possibility of illegal employment. They won't give us any info on insurance and now he has lost his income. Do we have any illegal employment indications or recourse to make them report the injury?

I can Find Employers Insurance Carrier

Although it would be ideal to have the employer report the accident, if they refuse I can do a look up on the employer's workers compensation insurance carrier and report the accident. The insurance carrier will then call the employer and ask about the accident and why it was not reported. You should communicate with the employer and advise them that you have that option and that they should simply file the accident report themselves. Workers Compensation is separate from any penalties he faces for underage employment. The insurance carrier may not even bother reporting any alleged violation.

I provide a free consultation on all workers compensation cases. You can contact me at (973) 481-4364. I have offices in Harrison and Newark (Ironbound Section).
