Legal Question in Workers Comp in New Jersey

W/c - fmla

If an employee is on W/C and is being treated as an FMLA and has exhausted the 12 weeks, can the employer pay them out their sick, vacation etc while they are still on W/C?

Upon a resolution of the case and perhaps a return to work these payments should credited back to you for future use. �Paid-out sick and vacation time� should be paid in addition to, and not in lieu of, any concurrent, weekly, w. comp. benefits paid.

If you were injured on the job all your medicals and your pay should be paid through workers compensation.You shouldn't be on FMLA and you should not have to use sick and vacation days either.
