Workman's Comp Law in New Jersey

An employee has been out for two months on workman's comp for an accident that happened on the job. He does not know when he will be able to return to work. The business in need of hiring someone to do his job now. It is a small company. When and if he is ready to return to work and the position has been filled, does the Company have to take him back even if they do not need him? What is New Jersey law regarding time frame on workman's comp. Do they have to keep the position open? Can they hire someone else.? Do they have to take him back?

Unless the employee has a union contract or some other employment contract that specifically says that the company must take him back, then the company does NOT have to take him back. They do have to keep paying him workers compensation benefits for as long as the authorized treating doctor says that he needs to stay out of work, however.
