Legal Question in Criminal Law in New Mexico

Grand jury perjury

Me & my brother set up a guy in order to not pay him his wages that we owed him back in 1989..

I lied to the grand jury.

This got the guy convicted of false charges.

After 12 years can I be charged for a false police report?

Re: Grand jury perjury

Why are you worried about being charged with "filing a false police report?" You should be more worried about being charged with perjury before a Grand Jury. Generally speaking, a statute of limitations does not even begin to run in cases of perjury, fraud/illegal concealment/etc. until the perjury, fraud, illegal concealment, etc., is discovered.

That means that there is no statute of limitations defense unless you make full confession to the police or DA's office or other competent authority. Once that is done, the statute of limitations "clock" begins to tick, not before. The New Mexico statute that applies is Section 30-1-9. Once the statute of limitations "clock starts ticking," the period is probably five (5) years.
