Legal Question in Criminal Law in New Mexico

My son was in a vehicle with two other people when the police pulled them over. The other two were arrested and transported to jail. My son was handicuffed & read his rights, but one of the policeman, told my son they would let him go if he would cooperate with them & call police dept with names of other criminals??? My son agreed because he was scared to death and they let him go. He called them and told them he didn't know any names of other criminals. The officier told him they are going to charge him with aiding & abading. They said he would hear from the DA's office Apparently, they said they(police) are sending paperwork to the district attorney to file charges against my son. Is this legal? What should we do now??
