Dui in nm

I was parked in the desert a vehicle drove up behind me, i thought i was in the way so i moved the vehicle. A spot light was then put on me so i was told to stop. A police officer came up to me and asked me what i was doing and asked if i had been drinking and i was arrested for dui

You have not asked a question. But if you could not pass the field sobriety tests and/or blew a .08 or better on the breath machine, then you are guilty of DWI under NM law. It does not matter where you were parked and it does not matter how old you are. By being in control of the vehicle and consuming an alcoholic beverage to .08 or more, you have committed DWI.
