Child Custody

my Divorce was in New mexico, & I live in California. My Ex husband just moved back to California. in the divorce he got Primary care because I had no place to live. He moved all of the children out to me slowly as in I kid a year or two. We have 3 Girls. Now he said that he has primary care & I have to do what he wants. is this True?? Didn't he give this up when he moved the girls out to me?? I have had them from 1 1/2 years to 4 years depending on the child. I also have no $$ to retain an attorney they all want 10k to start. Please help. thank you.

10k is extremely high. keep looking. there are a lot of good lawyers that would charge you 1/10 of that and arrange a payment schedule.

I don't know why an attorney would want 10k to start. You need a certified copy of the decree from New Mexico, file that with the court in the county that you live and then file a motion to modify the order. Do that ASAP, you can then have a California order giving you custody. I would charge $950 to file such a motion and ask for child support. You could probably pay off the attorney's fees within months just from the child support. I'm sure that there is an attorney near you that would quote a similar figure. Good Luck, Pat McCrary.
