how can I modify visitation or set a new hearing, My ex has refused to take kids to mediator

I assume from your question that you have filed for a custody determination either as part of a divorce proceeding or a paternity proceeding if you were not married, and have been ordered to mediation by a court. If the ex has refused to attend a court-ordered mediation you can file for an order to show cause - asking the court to find the ex in contempt. If you have been trying to solve this without one of the prcoeedings mentioned, then you should file for a custody determination in court. If you are or were married, this means filing for a divorce or for a change in the parenting plan if you already have one. If you were not married you can file a peternity action. To change court-ordered visitation you file for a change in the parenting plan based on changed circumstances.
