Legal Question in Family Law in New Mexico

I wanna ask if i have a rite to pick up my child who is with her father he is tellin me i cant get her and he does not have custody or any document sayin that i dont have the rite to have her with me?

If no court has determined child custody between biological father and mother, each has an equal right to physical custody of the child. If the father is not listed as such on the child's birth certificate, then he has no right to custody of her at any time. Only the mother.
