Legal Question in Family Law in New Mexico

I am two years divorced. The divorce decree states that we are to sell the home and split the equity. She has remained in the house, refuses to communicate, and won't put the house on the market. What recourse do I have since my name remains on the mortgage.

You file an ORDER TO SHOW CAUSE. The judge can then make a monetary damage award against her as her 'punishment' for failing to follow the court order. You are the one being damaged here. You will likely need to have an attorney do the drafting for you. If you have a self help law center at the court they might have a form pleading for you. You can also check the 1st judicial district court and the 13th judicial district court for a form 'motion' and 'order' to show cause.
