Legal Question in Civil Litigation in New Mexico

Band taken for a ride

I have a band and we were trying to record an album. The person we were recording with charged us $500 start to finish. We could never get ahold of him and everytime we went to record, he gave us the runaround. We finally decided to go with another studio because he had not recorded anything usable for us. He refuses to reimburse our money saying we were in breech of contract, although he never provided any services to us. What can we do?

Send him a certified letter. Keep a copy. Give him 10 days within which to refund your money or you will take him to Magistrate's Court.

If he doesn't pay, sue him in small claims [Magistrate's] Court. They have the forms.
