Legal Question in Landlord & Tenant Law in New Mexico

My daughter was going to rent an apartment in NM, and had a copy of the lease and 1st months rent and was supposed to see the apartment before turning it over. She was not allowed to see the apartment before giving them the paperwork, and decided the apartment was not safe, requested the lease back (within 5 minutes) and it was refused. Now they are holding her to the lease. is there a time when you can have it returned and is it her property?

The answer to your question is "Yes." Ask your daughter to go by NM Legal Aid downtown on 3rd street. They will very likely be able to help her out. If not, they can point her in the right direction. They also have a renters guide there that they give away for free. It has a very good summary of the law.
