Legal Question in Real Estate Law in New Mexico

Evicting a roomate

My neigbor's roomate has not paid his share of the rent and he need to know what options he has and what procedures he needs to follow in order to have this person evicted within the law. He does not have a written contrct with this person, only a 'verbal' contract. His roomate owes his part on past due rent and utility bills.

Re: Evicting a roomate

Depends whose name is on the lease with the owner of the house. If your name is on the lease only then you are totally responsible to pay the owner even if you have an agreement with the roomate. If the roomate doesn't pay but there is an agreement even though it is not in writing it is binding under certain circumstances. Best bet is to seek a local attorney and to pay the rent or be subject to the owner evicting your neighbor. There are fairly simple laws to get rid of a roomate but they are specific to your area and your neighbor needs a local attorney to give this advice.
