Legal Question in Real Estate Law in New Mexico

I was in the process of buying a house. I had a cleaning business but I lost the contracts. I no longer have the income to buy the house. I put $5000 down. The builder is tying to get his people to give me financing or he is going to take me to court for breach of contract. Can he do that? And is it possible I can get my money back?
