Vehicle Liability

My daughter's car was taken without her permission and the driver did not have a license or insurance. The driver was issued three seperate tickets, one for wreckless driving and the others were for driving without insurance and driving without a license. The police report states that he did not have permission to drive her car. My questions is does the law require that he pay for damages to the car. He had agreed to pay for damages but his parents do not agree to pay and they will not pay. Who is liable for the damages and what does the law state. Thank you very much

One who causes economic loss to another is liable to pay the damages. Parents are responsible for the acts of their minor children in New Mexico only under certain circumstances, and with a limitation on the amount.
