Legal Question in Wills and Trusts in New Mexico

My wife passed, leaving a will naming me as executor, and that I inherit all of her estate. Do I need to probate the will? All debts of the estate have been paid, but I am trying to change the title on the house to my name, and my new wife's name.

It sounds like you can do what is called "a simple probate." If you got to this website: http://nmsupremecourt.nmcourts.gov/legal-forms/vprobate_code.php you should be able to find all of the forms that you will need to fill out and take to the probate court in your county. A simple probate filing fee is $30.00 and the judges and their assistants are usually pretty nice and quite helpful.

Hope this helps.
