Legal Question in Personal Injury in New York

Dog Bites

My friend was on vacation in Maine (she lives in NY) and her dog was attacked by another dog(that dog's owner lives in NJ).

Her bills so far have reached about $1000 and she has been so stressed about this matter she herself is running to the Dr.

The dog's owner refuses to pay any of the bills. Does she have to go to Maine to sue?

I'm not absolutely sure, but I'm pretty sure she "could" sue in federal court in NJ. The problem is that the cost of suing in federal court is so much that it doesn't make sense for $1000.

Another alternative may be small claims court in NJ - where the defendant lives. But you'd have to check the rules of that court. It's probably the best option for such a small amount of money.

You may bring an action in New Jersey, as the courts of any State have jurisdiction over residents. Consider Small Claims Court where jurisdictional money limits may suffice, and lawyers (and their fees) are not necessary.
