Legal Question in Disability Law in New York
I am a co-mortgagee on a purchase money mortgage upon which one of the other co-mortgagees is also a co-mortgagor. Mortgage is in serious default. Value of property is much less than outstanding balance on loan(200M). Transfer of deed has been proposed but mortgagors are making things difficult along with the other co-mortaggee who is just not being responsible as an executor. Would suing on the note be an option? What about a summary judgement?
