Legal Question in Disability Law in New York

Good Afternoon,

Long story short, My husband was terminated for a disability. He is in negotiations with his employer, the union who represents the employees and has a case open with the EEOC. The employer requested that he see another Dr. at the Insurance underwriters request to confirm his primary Dr's findings. Which is not a problem, however no one can answer the following question

Who should pick this independent Dr?

Insurance company's regularly retain doctor's to conduct so called independant medical examinations ("IME"'s) and the insurer will not be satisfied with their exam unless they choose the doctor. Nor should you expect an objective opinion from such a physician.
