Legal Question in Administrative Law in New York

Hi, My question is in 1957 my dad being a military veteran purchased a two family house along with his sister. The mortgage was paid off years ago and they ended up splitting the taxes and utilities each year. My Mom passed away 8 years ago and my dad remarried in 2012. My dad keeps paying the taxes along with his sister but he moved to Virginia. Our family grew up in the upstairs part of the house and his sister and her kids had the bottom half of the house. My only other brother is still living in the upstairs part paying the utilities. If anything happened to my dad as the biological son do I have any rights to the house if its sold.

Does your dad have a will? Normally, his present wife will inherit everything as of right in the absence of a will. Virginia Law is controlling since he is a present citizen of the State.
