Legal Question in Bankruptcy in New York

bankruptcy petition & schedules

I filed chapter 7 and just received notice from the trustee requesting a copy of the debtors signed petition and schedules. Do I need to send him the ENTIRE copy of the bankruptcy pettion that I previously filed with the district bankruptcy court? Thank you.

Re: bankruptcy petition & schedules

Yes. You must immediately send a photocopy of the COMPLETE petition to the trustee, together with your last tax return, your pay stubs, and your credit counseling certificate.

Since you do not have an attorney, you must proceed very carefully. There are a great deal of rules under the new bankruptcy laws and your case can be dismissed if you neglect to adhere to them. Many pro se cases get dismissed because the debtors do not do what they are required to do.

There is a lot of information on my bankruptcy blog about the various filing requirements:

Good luck!
