Chapter 13 Proceedings

To Whom it May Concern:

I recently filed Chapter 13 on my own. My court date is coming up and I am a little nervous about what is going to happen with my car. I included it in my repayment plan and am wondering if there is anything they can do to have it not included in my repayment plan and reposess the car? Thank you for any help you can provide.

Chapter 13 Inquiry

Talk to the Chapter 13 Trustee. See whether the plan you submitted is acceptable. The Trustee will tell you what needs to be done to protect your car and other assets. As long as the creditor on the car loan is being paid from the Plan, there is adequate protection and the car cannot be repossessed.
