Legal Question in Bankruptcy in New York

Credit Card Debt used for College Tuition

Understanding student loans are not exempt when filing bankruptcy what happens if the tuition was paid with a credit card because the child's student loan was not to the school before the due date. The student loan came later but was not paid back on the credit card because it was used to pay bills. Can we the parents still include that credit charge for that tuition in personal bankruptcy? The child will be paying the actual debt of the student loan.

Re: Credit Card Debt used for College Tuition

If you are saying that you paid for college with a credit card, yes you can include that credit card in bankruptcy. (You are not including the student loan).
