Legal Question in Bankruptcy in New York

I filed a lawsuit, pro-se against my lender. I then filed a chapter 13 bankruptcy but did not list the lawsuit as an asset. I informed the assigned attorney that I did not do a plan because I have a lawsuit against the lender so he stated that I didn't qualify for a 13 and I can't do both. I told him I wanted to pursue the lawsuit and my case was dismissed. Being that I didn't list the lawsuit asset, does it remain the property of the bankruptcy.

New York Bankruptcy Lawyer If the case is dismissed there is no bankruptcy estate. Please do not continue to handle your own cases "pro se"
