Release of Levy

A collection company for a credit card company has placed a levy on my bank account. Is this legal and will filing a Chapter 7 get the levy released?

Re: Release of Levy

This sounds unusual to me. While a CH 7 (or other CH) will help you, the 'levy' may not have been properly established. I would like to see the documents on this action. You are welcome to a consultation at no fee at my offices at 42 West 44th St, NY,NY. Please call for an appointment first (646) 591-5786.

Re: Release of Levy

Can only place a levy AFTER receiving court order to do so. There would have been a hearing of which you Must have been notified. If you did not receive notice of the hearing, email me and I will respond further.

Re: Release of Levy

Depending on your situation, a Chapter 7 may release your funds (although, the Chapter 7 Trustee may reclaim that money from your creditor for himself). Please call my office to schedule an appointment to discuss your options. You have nothing to lose and everything to gain.
