Legal Question in Business Law in New York

Lost Check

A check was sent to EZ-Pass, however, they deny to have ever recieved or cashed it. The Check was cashed and the EZ-Pass company will not refund the money. I have spoken to many Ez-pass representatives a repeated number of times and all they do is give me the run-a-round. As a result many months have passed and I am still in the same spot. Nobody seems to know what to do about it and the company denies responsibility. I would like to know where and how to go about resolving this problem. Thank you.

If you have the canceled check, sue in small claims court.

Call the Company again and ask to speak to a manager (and be sure to get that manager�s name). If at the end of the conversation you have not gotten any satisfaction, write a letter to that manager, enclose a copy of the canceled check and send a copy to the company�s general counsel and/or president of the Company. In your letter consider advising the Company that you are giving them a certain amount of time to rectify this matter (for example, �within 14 days...� or �by April 8, 2002') and if you do not have your

refund by that time, you will contemplate all legal options available to you. If you still don�t get any satisfaction, consider small claims court.
