Legal Question in Business Law in New York

Does an organization have the right to restrict the number of members who attend a monthly meeting because the room is restricted to 94 persons by the County and Fire Department when the total membership is 200. Each member does pay a membership fee. Thank you.

If the code restricts occupants to 94 then there is nothing to be done about that other than move the venue.

If your membership provides for in-person meetings of members, then of course a member can complain that they are prevented from attending. If you regularly get close to the max allowed under code then you should consider a new venue that will accommodate everyone.
