Legal Question in Business Law in New York

sanitation tickets

Hello! I am the owner of a fruit & vegetables store. Two-three times a week I get sanitation tickets for, honestly, ridiculous things. I have about 1000 tickets unpaid (every ticket-$250) and still getting them. The problem is that sanitation department sends the copies of those tickets to my landlord (I rent 1st floor of the building that belongs to him).

Question: does sanitation dept have a right to do so (to involve my landlord in) and can they force the landlord to force me to pay for those sanitation violations?

Re: sanitation tickets

Yes, they do have that right, and yesm the landlord can require you to pay. You need to address this situation quickly.

Re: sanitation tickets

Welcome to New York City. I had a client that broke 3 branches with his paint truck. 3 tickets for each branch, each ticket $1,000.

The landlord is the property owner. The tickets will create a lien on the property that he will have to account for when he sells the property. I have not read your lease, but I assume that in your lease you agreed to be responsible for fines. And even if you do not have a lease, you would still be responsible for fines.

So yes, the landlord can force you to pay for the violation. And I agree with David, you better correct the problem soon.

Mike.
