Legal Question in Civil Rights Law in New York

Sexual Orientation Discrimination

I have been employed with a company that has fired me for lies. Within the four years employed there, I have been a target of discrimination. I even have someone on tape saying that is why I am being harrassed. Do I have a case?

Thank you,

Re: Sexual Orientation Discrimination

Perhaps. It depends if the stated reason for your termination was the actual reason for your termination, or not.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Re: Sexual Orientation Discrimination

New York State recently amended the HUMAN RIGHTS LAW to include sexual orientation as a protected classification, along with race and gender, age and religion etc.

So if your question is whether sexual orientation discrimination can be the basis for a hostile work environment

suit, the answer is yes. But you need other important elements. You must have

been subjected to harassment that a reasonable person would consider makes

the work environment difficult

or impossible to function in. If you

are still employed, you must have suffered some sort of adverse employment action, such as a suspension, demotion or salary cut.

Is the person on tape a supervisor or member of managment?
