Legal Question in Technology Law in New York

disclaimer for violent web graphics?

I am posting some images on a web site that are violent. They are

images of wounded soldiers taken by a photojournalist. Do I need some

kind of disclaimer? 18 or older to enter? that kind of thing.

Re: disclaimer for violent web graphics?

If the works are copyrighted you'll need the permission of the copyright owner. You may want to put up a disclaimer about the graphic nature of the images but there is no applicable law requiring you to do so. You may, however, hear from the people in the images or their family members/heirs (if dead), with a claim to invasion of privacy or infringement of the right to self-promotion/publicity. This is a somewhat grayer area in which it is not really possible to give you advice based on the facts in your query. You should, however, be especially worried about this last issue if you are charging a fee to receive the images or view them.
