Legal Question in Construction Law in New York

Can a corporation use a dba

I signed a construction contract with a company called ''Toughtime Constructions Corp.'' I found out that the name of the Company has been changed since 2004 to ''Tuftyme Associates Inc.'' can they continue to use the name ''Toughtime Constructions Corp.'' as a ''DBA'' if the changed that name in 2004. Because he had me make out my checks to him in the name of ''Toughtime Constructions Corp.'' and he deposited them into ''Tuftyme Associates Inc.'' I also found out he is not registerd with the state as having a dba so can he do that I signed my contract with him on July 2005 Please help

Maybe there is something odd going on. There does not appear to be any record of an entity named Toughtime anything in the State of New York, and Tuftyme likewise generates no hits at the Secretary of State's office.

This is a meaningless exercise in the abstract, which is to say that if you have a construction law question, the lawyers on this board might be able to respond meaningfully, but you have not posed a construction question.
