Legal Question in Construction Law in New York
A friend's landlord has decided to tear up a strip of grass and trees along the border of the building's property line, and replace it with a parking area. The cars will be no more than 7-8 feet from the windows of the first floor units, one of which is being leased by said friend. What are the applicable zoning laws for this, and is there any remedy, upon which my friend can take action, for the health risks involved with the fumes coming into the apartment. The windows are located on the windward side of the building, and even the fumes from the heavy machinery can be clearly smelt inside the apartment.
