Legal Question in Construction Law in New York

House problems

Due to the fact that 24 years ago my contractor did not build according to the blue prints, my house now has structural problems. He was supposed to use 4x6 columns but used 4x4 and the footings were supposed to be 3 feet deep and are less than 1 foot. My home is sinking in one corner probably because of the footing sinking and the 4x4 column cracking and bowing. Do I have any recourse with the builder or the town which did not inspect properly?

Sadly the town does not owe a duty to you as a specific owner. However you would have to check on the guarantee that was given between you and the builder to see if you still have any claims. I doubt that any claim exsists this late in the game. Have you thought about your homeowner's insurance?
