Credit Card Debt - Elderly Parent
My Mom has recently been admitted to a skilled nursing facility for long term care. A few years back, we executed a durable power of attorney in NYS; now I am acting as her POA given her medical situation (dementia). She has accumulated over 25K in revolving credit card debts. Since she has no assets or resources, and will leave no estate, I would like to notify her creditors of her situation so they will stop sending threatening letters and collection calls. I know I have no personal liability with regard to her debts. If I notify her creditors, are they likely to stop billing and suspend the account or will we continue to be plagued with their tactics.

When a creditor contacts you, ask that they stop contact because the mother has dementia and no assets. Tell them to commence an lawsuit to obtain a judgment since there are no assets.
