Legal Question in Consumer Law in New York

official name change

I have a legal question about an official name. My boyfriend has a different last name on his birth certificate than on his social security card. He has his dad's last name on his birth certificate but he always used his mom's last name for taxes, ss card, work etc.

He didnt even know the birth certificate was wrong until he went to City Hall and they wouldnt sell him a copy because it wasnt his right name. Now he is having trouble getting a learning permit and a passport which he will need to go to Canada next year. What can he do to get a birth certificate with his correct name? Nobody will believe him at City Hall to get the right birth certificate and the post office and dmv wont help either. We just dont know what to do.

Re: official name change

You can petition the Court for change of legal name under NY Civil Rights law. The petition would include a certified copy of his birth certificate and the reason why he wants to change his name to that on his social security card.
