Legal Question in Consumer Law in New York

Rescind a sale

A geologist buys a rock from an inexperienced sales clerk at the Crystal and Mineral shop for $35. Shortly thereafter the rock is determined by experts to be an uncut gemstone worth $1.5 million after it is cut. The experienced long-time owner of the shop seeks to rescind the sale? Is he likely to be successful in court?

Re: Rescind a sale

Interesting question. Could not be answered w/out the benefit of research. My gut tells me it is a valid sale; however, another part of my gut tells me that there is probably case law on the subject, which may help in arguing otherwise.

Pls. feel free to contact my office if you would like to discuss further.
