Legal Question in Credit and Debt Law in New York

Answering a Summons

What happens if I do not answer a summons? Also since the summons was served to my wife and not me (to whom it was addressed), do I have 10 days or 30 days to answer?

Re: Answering a Summons

Failure to answer a Summons will result

in the eventual entry of a default judgment

This may be done by either the Clerk of the

Court or upon application to the Court, depending

upon the nature of the debt

Service upon the spouse is legal. It is

known as substituted service. It does not

extend the normal answering time to

30 days. I would get the answer in asap

Re: Answering a Summons

If you do not reply, a judgment will be entered against you by default. I suggest you retain an attorney.

Let me know if I can be of help.
