Legal Question in Credit and Debt Law in New York

Collections Statute of Limitations?

Is there any ''statute of limitations'' on bill collection? I've received a bill from a phone company for money I owe them from a June 1998 phone bill that they have not attempted to collect since then. Do I have to pay them?

Re: Collections Statute of Limitations?

The collection by a phone company for non-payment of a bill is a breach of contract action. In NY, the statute of limitations for breach of contract is six years. While you may have other defenses to the claim, statute of limitations does not seem one of them.
