Legal Question in Credit and Debt Law in New York

old credit card debt

I owed some credit card debt back to 2003. However, I lost my job and sold my my home and moved around in NY to work temporary jobs and I was lay off last Month, it is impossible for me to pay the debt. I just received a suit filed by a credit card company. People told me there is statute of limitation for credit card company to go after the person. It is almost 6 years now, can I claim of Statute of limitation?

Re: old credit card debt

the six years runs form the last time you did something in relation to the debt, either used the card or made a payment. If you have made no payments and not used the card since March of 2003 you can claim the statute. The best defense here is to ask they prove the debt by showing your signature on purchases and agreements. good luck.
