Legal Question in Credit and Debt Law in New York

I am going through debt settlement to clear up about 16, 000 dollars in credit card debt. Yesterday, the Sheriff came to my house and issued me a summons on behalf of one of my credit cards. My question is willl I need to go to court? Do I have an attornry through debt settlement that can handle this for me? Can they take my car or garnish my wages?

A. If you do not appear and file an answer to the summons and complaint, the plaintiff may be able to take default judgment against you. Therefore, you should go to court.

Q. Do I have an attornry through debt settlement that can handle this for me?

A. That would depend on the agreement between you and the debt settlement company. Generally, the answer would be no.

Q. Can they take my car or garnish my wages?

A. Generally, the answer is yes. However, there are exceptions as set forth under law.
