Legal Question in Credit and Debt Law in New York

Judgement

I was a witness to an accident and was named as a defendant in a suit that I was never properly notified of, now there is a entered judgement of over $100,000. The officer took my information and the plantiff has sued me. Also, I was in a company car on that day, working. What can I do.

Re: Judgement

You have to bring an action in the court to vacate that judgment. Consult an attorney if you need help.

Re: Judgement

You have to prepare, file and serve an Order to Show Cause to vacate the Judgment. In the motion, you must demonstrate an excuse for the default (never served) and a meritorious defense (witness and not in the accident).
