Legal Question in Credit and Debt Law in New York

judgment

my fiance has had his bank account frozen by a coolection firm. he never recieved any prior notice as to this debt and does not know what it is about, but they were able to go to court and get a judgment against him. he did not know anything about it and did not even get to go to court. how can this happen. now we cant pay our mortgage etc. what to do?

Re: judgment

He has to act quickly by filing a motion by Order to Show Cause to vacate the Judgment on the basis that he was never served with the summons and complaint.

It is easiest if you contact and retain an attorney to draft the papers. Sometimes a clerk will help by providing the necessary papers allowing you to file the motion yourself.
